An Examination of The Cross-Border Protection of Copyrighted Works In Nigeria

In today’s world, the international dimension of intellectual property is increasingly important. Intellectual Property rights are of growing importance in most countries due to their significant impact on a nation’s social and economic life. The protection of intellectual property rights is imperative as it serves as an incentive for creators and inventors to contribute to the development of society.

In a bid to ensure the protection of intellectual property rights, various countries have enacted diverse legislation. For example, some laws governing IP rights and protection in Nigeria include Copyright Act 2022, the Patents and Designs Act, the Trademarks Act, Merchandise Marks Act, and Trade Malpractices (Miscellaneous Offences) Act.

The essence of enacting these laws is to combat intellectual property rights violations such as piracy, counterfeiting and any other form of infringement of individual intellectual works. Several countries have enacted laws tailored to their specific economic need; as such, these laws differ from one country to another. It is therefore imperative to protect foreign works in Nigeria to prevent situations of cross-border breach.
