Although the basis of jurisdiction in an arbitration is the agreement of parties to arbitrate or to submit arbitration (whether or not driven by Rules of Court or legislation), an arbitral award once properly made carries the effect of a judgment provided that all the material criteria are fully met. It is of particular importance that arbitral awards are recognized and enforced. Without recognition and enforcement, the award would become a mere opinion, at best persuasive of ways of resolving the dispute in question. (Excerpts)
